What are the benefits of mediation?
Divorces are often stressful for couples who may be uncertain about the future of their financial situation and the custody of their children. In Tennessee, couples are required to go through mediation before they go to trial for a divorce. Legal fees associated with mediation are much less than fees for going to trial. Mediation is usually less expensive and reduces conflict.
So how does mediation work?
Mediation is the process through which divorcing parties meet with an impartial third party (the mediator), who reviews the facts of the case and helps the couple to reach an agreement that is satisfactory for both parties. Typically, this means husband is in one room with his attorney, and wife is in another room with her attorney. The mediator will go back and forth between rooms with “offers” from either party, until they come to an agreement. The mediator is unbiased, meaning they don’t work for either side. The mediator is just there to help the couple come to an agreement.
